3. ACCURATE INFORMATION & PERJURY

When you submit a DMCA notice, federal law requires that you include certain statements under penalty of perjury. Submitting false or misleading information could lead to criminal penalties or civil liability. Please be sure you:

  1. Conduct a thorough investigation to confirm the content is infringing.
  2. Consult an attorney if you have doubts about fair use or other legal doctrines.

4. HOW TO SUBMIT A DMCA TAKEDOWN NOTICE

4.1 What to Include in Your Notice

A valid DMCA takedown notice must include all of the following:

  1. Identify the work you claim has been infringed (e.g., a link to your original or a clear description).
  2. Identify the allegedly infringing material on our websites (specific URLs or clear location instructions).
  3. A statement of good faith: You must declare that you believe the disputed use is not authorized by the copyright owner, its agent, or the law.
  4. Accuracy & authorization: A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  5. Your contact information: A mailing address, telephone number, and email address.
  6. Your signature: A physical or electronic signature (typing your name at the end of an emailed notice is acceptable).

4.2 Prefer Plain-Text Email

We recommend sending your notice via plain-text email to [email protected] for the quickest possible processing. If you prefer physical mail, please be aware that there may be a significant delay before we receive and process it.

4.3 Acknowledgment of Disclosure

By submitting a DMCA notice, you acknowledge that we may share the entire notice — including your personal information — with the user who posted the allegedly infringing content or with third parties as necessary to resolve the claim.


5. COUNTER NOTICES

IWecan remove or turn off content in response to a DMCA takedown notice. In that case, the affected user may submit a counter notice if they believe the takedown was in error or the material is lawfully used. This counter-notice must also comply with the DMCA’s requirements (including the user’s signature and statements under penalty of perjury).

  • Reinstatement Timeline: If we receive a valid counter-notice, we will typically restore the content within 14 days unless the original claimant notifies us that they have initiated legal action seeking a court order against the allegedly infringing party.

6. HANDLING REPEAT INFRINGERS

We strive to respect the rights of copyright owners while maintaining a platform for our users to share content. If a user is found to be a repeat infringer, we may, at our sole discretion, disable or terminate that user’s account.


7. INVESTIGATE BEFORE FILING

Filing a DMCA claim is a serious legal step. It can lead to the removal of content and potential legal disputes. We encourage you to:

  1. Contact the user directly if possible. Sometimes, misunderstandings can be resolved without a formal DMCA complaint.
  2. Ensure the use isn’t permissible under the doctrine of fair use or other exemptions.

Automated “bot-based” notices that do not account for fair use are often invalid and can result in the wrongful removal of lawful content.
